Buyer beware
I work for a small non-profit (about 15 full-time employees) and in 2021 our organization was interested in implementing a search tool for one of our flagship applications.
After doing some research we settled on Mindbreeze. We signed a one-year contract in December of 2021. After using the product for most of 2022 we decided we no longer wanted the tool and had planned to terminate the contract in the Fall of 2022. The sales folks at Mindbreeze we were interfacing with said no problem and passed the request on to finance. In November of 2022, we were told that the previous contract we signed contained a clause that required that we give Mindbreeze two months' notice before we could cancel that the contract. Due to this oversight, we were forced into another year of an agreement that will cost us over $80,000 for another year of services for a product that we are not using and do not want.
Is it legal? I am not a lawyer so I won’t comment. I will just say that if you sign a contract with Mindbreeze do read the contract and give yourself plenty of time (three or four months) before the contract expires to contact them and terminate the contract.
This unwanted contract has caused serious damage to our organization and is drawing funds away from a number of public good projects. After explaining all this to Mindbreeze all they did was hand us off to lawyers that insisted the contract had to be paid or it would be turned over to creditors.
Shame on you Mindbreeze!
